Acceptance and eligibility

By accessing or using the website, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the website.

You must be legally capable of entering into these Terms. If you use the website for a company or other organization, you represent that you have authority to bind it. The website is not directed to children under 13.

Website license

Subject to these Terms, Passback Inc. grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the website for lawful informational, support and purchasing-related purposes. No ownership right is transferred to you.

Prohibited conduct

• Violate law, regulation, third-party rights or these Terms.
• Attempt unauthorized access to accounts, systems, source code, data or security controls.
• Introduce malware, automate abusive requests, overload the service or interfere with another person’s use.
• Scrape, copy, frame, mirror, reverse engineer or commercially exploit the website except as expressly permitted by law or written authorization.
• Misrepresent identity, affiliation, product origin, endorsement or support eligibility.
• Use website content, product imagery or trademarks to create counterfeit, confusing or unauthorized products or promotions.

Product information and compatibility

SOOLRA™ products are model-specific. Before purchasing, verify the exact iPhone model, product variation, color, SKU, included items and compatibility stated on the live Amazon or other authorized marketplace listing. Images, demonstrations, development concepts, app screens and availability information may change and may depict pre-production or illustrative configurations.

Website descriptions are general educational material. The live marketplace listing, product packaging, safety information, user instructions and any written limited warranty supplied with the purchased SKU control if they conflict with general website content. Do not use a product in a manner inconsistent with applicable safety instructions.

Amazon and other marketplace purchases

This website does not currently process product orders or payment cards. A purchase initiated through a Buy on Amazon link is completed by Amazon under the price, taxes, shipping, return, payment, privacy and other terms shown on Amazon at checkout.

Amazon is a separate service. Passback Inc. may act as seller or brand owner for an applicable listing, but does not control the Amazon platform, account access, checkout, delivery network or marketplace policies. Order status, cancellation and standard return requests should begin in Amazon Your Orders. Nothing in these Terms limits rights that cannot lawfully be waived under marketplace rules or consumer law.

The SOOLRA™ app and game content

The SOOLRA™ app is distributed through Apple and is subject to the applicable App Store terms, app privacy information and any end-user license terms presented with the app. App features, supported file formats, games, rewards, virtual items and compatibility may change by version, device, region and rights availability.

Third-party games, services and trademarks belong to their respective owners. Availability of controller support in a third-party game is determined by that game or platform and may change. You are responsible for obtaining and using game files and other content only when you have the legal right to do so.

Support communications and submissions

When you contact us, provide accurate information and do not submit passwords, full payment-card details, unlawful content or information you are not authorized to share. You grant Passback Inc. permission to use the information you submit to respond, troubleshoot, protect the service and maintain appropriate records.

If you voluntarily provide non-confidential feedback or suggestions about the website or products, Passback Inc. may use them without restriction or compensation. This does not transfer ownership of your personal information, which remains governed by the Privacy Notice.

Intellectual property

The website, SOOLRA™ name and marks, product and interface designs, text, graphics, software, photographs, videos and other original material are owned by or licensed to Passback Inc. or its licensors and are protected by trademark, copyright, patent, trade dress and other laws.

No right to use a mark, patent, design, copyrighted work or other intellectual property is granted except the limited website license above. Third-party names, logos and content remain the property of their respective owners; reference to them does not imply sponsorship or endorsement.

Third-party links and services

The website may link to or display content from Amazon, Apple, Meta, YouTube, publications, game publishers and other third parties. Passback Inc. does not control and is not responsible for their availability, security, accuracy, content or practices. Your use of a third-party service is governed by that service’s terms and privacy notice.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PASSBACK INC. DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AS TO THE WEBSITE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR THAT ALL INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT.

These website disclaimers do not replace or reduce any express written product warranty or non-waivable consumer right applicable to a product you purchase.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASSBACK INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM THE WEBSITE OR THESE TERMS.

Any liability that cannot lawfully be excluded is limited only to the maximum extent permitted by applicable law. Some jurisdictions do not permit certain exclusions or limitations, and nothing in these Terms excludes liability or a remedy that cannot legally be excluded or limited.

Governing law and resolving concerns

To the extent permitted by applicable law, these Terms are governed by Delaware law without regard to conflict-of-law rules. Mandatory rights and protections available under the law of your residence remain unaffected.

Before filing a claim, you and Passback Inc. agree to make a reasonable good-faith effort to resolve it by written notice. Send notices to info@soolra.com with “Legal Notice” in the subject line. Nothing in this section prevents either party from seeking urgent relief or using a lawful small-claims or consumer-protection process.

Changes, suspension and severability

We may modify, suspend or discontinue any website feature and may update these Terms as law, products or services change. Updated Terms apply from the effective date shown. If a court finds a provision unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Passback Inc. may assign them in connection with a reorganization, financing or transfer of the relevant business.
